The definitions provided in section 2 (1)(i), section 2 (ha) and Section 2 (1)(j) of IT Act, under heading “Computer”, “Communication Device” and “Computer Network”  have made the point clear that the legal status of mobile phones and Smart Phone devices are the same in Indian legal scenario like that of a computer. Even the IT Act defines "Communication Device" which means Cell Phones, Personal Digital Assistance (Sic), or combination of both or any other device used to communicate, send or transmit any text, video, audio, or image.
